The loss of a loved one is the most difficult experience any person can go through in their lifetime. A significant portion of our cases involve clients who have lost a family member due to drunk driving, medical malpractice, criminal wrongdoing, or some type of accident caused by negligence. These are some of the most difficult cases because nothing is more devastating than the unexpected death of a family member, especially when it is tragically caused by the illegal or careless conduct of another party. However, we urge you not to wait when considering whether to hire an attorney.
If the death resulted from an accident where the evidence can quickly disappear, it is important to have someone on your side to preserve the truth. Additionally, depending upon the type of case, there are strict time limits in which to present your claims on behalf of your loved one.
When a loved one dies because of someone else’s negligence, the law provides that the surviving spouse, children, parents, and/or other relatives may file a claim against those responsible for causing the wrongful death. While we certainly understand that no amount of money can ever replace your loved one, a monetary award is the only way civil law can recognize the value of your loved ones’ life and help you take care of those unexpected costs that are associated with the death of a loved one, such as medical expenses, funeral expenses, lost income and benefits, pain and suffering, and in some cases punitive damages.
Today, the current version of Georgia’s Wrongful Death Act is codified in the following code sections:
• O.C.G.A. § 51-4-1 “Definitions”
• O.C.G.A. § 51-4-2 “Homicide of spouse or parent; survival of action”
• O.C.G.A. § 51-4-4 “Homicide of a child”
• O.C.G.A. § 51-4-5 “Recovery by administrator or executor of decedent”
• O.C.G.A. § 19-7-1 “Parental power; recovery for homicide of child”
Many firms have experience in helping clients with these types of cases. Our firm is a little different in that we have lawyers who have been the ones to conduct death investigations and understand things about these cases that most lawyers will never experience. This allows us to understand right away if there have been mistakes to cause injuries and wrongful death.
We have also have members of this firm who have went through personal tragedies not unlike the cases we prosecute for our clients. If you want to have a group of individuals who understand firsthand what you have experienced and what you are going through, our office is the one to represent you in your case.
